Male Violinist Files Lawsuit Against Will Smith Over Harassment and Career Retaliation

In a high-profile legal filing that has sent shockwaves through Hollywood and the music world, actor and musician Will Smith is facing a lawsuit from a violinist who performed on his 2025 concert tour. The complaint, filed on December 30, 2025, in the Superior Court of California, County of Los Angeles, accuses Smith and his production company of sexual harassment, wrongful termination, retaliation, and intentional infliction of emotional distress — marking one of the most serious legal challenges of Smith’s career.

The plaintiff, Brian King Joseph, 33, is a professional violinist and recording musician who gained national recognition as a finalist on America’s Got Talent in 2018. Joseph alleges that what began as a professional collaboration with Smith deteriorated into a pattern of inappropriate conduct, culminating in a traumatic incident during the tour’s Las Vegas stop in March 2025, followed by his alleged dismissal in retaliation for reporting the matter.

Smith, 57, best known for his decades-long acting career and recent music projects including the “Based on a True Story: 2025” global tour, has not been charged with any criminal offense. The lawsuit is a civil claim seeking damages for emotional trauma, lost wages, damage to reputation and other economic losses related to his termination from the tour.

Background: The Professional Relationship

According to court documents and reporting by multiple outlets, Joseph’s professional relationship with Smith began in late 2024. After performing with Smith at a show in San Diego, Joseph was invited to join Smith’s planned 2025 world tour, titled Based on a True Story, and was also slated to work on Smith’s upcoming music album.

In his complaint, Joseph says that in the months leading up to the tour, Smith made comments suggesting a deeper emotional connection than would be expected between a star and a touring musician. Joseph cites one instance where he claims Smith told him, “You and I have such a special connection that I don’t have with anyone else.” Joseph characterizes these remarks as part of a “grooming” pattern — a phrase he uses throughout the complaint to describe Smith’s alleged behavior.

Joseph officially joined the tour in early 2025, performing at shows across the United States and Europe, including a key stop in Las Vegas in March 2025. It was during this Las Vegas leg of the tour that the lawsuit’s central controversy occurred.

The Las Vegas Hotel Incident

Joseph’s complaint centers on a single night in March 2025, when he returned to his hotel room — booked and paid for by Smith’s tour management — after performing a show. According to Joseph, his hotel bag, which contained his room key, went missing for several hours and was later returned by a member of Smith’s management team. That same night, Joseph alleges that when he returned to his room, he found evidence that someone had entered without his consent.

Court filings describe a series of items found inside the room, including a bottle of HIV medication with another individual’s name on it, used wipes, an empty beer bottle, a red backpack, an earring, and hospital discharge paperwork belonging to someone Joseph did not know. Most notably, the complaint claims that a handwritten note signed “Stone F” was left on a desk. Reportedly, the note read:

“Brian, I’ll be back no later [sic] 5:30, just us (heart), Stone F.”

According to the complaint, Joseph interpreted the note — combined with the presence of personal items belonging to someone else — as implying that an unknown person intended to return and engage in sexual activity with him. He says the incident left him fearful and distressed, prompting him to immediately report the situation to hotel security, a non-emergency police line, and members of Smith’s tour management. Joseph also took photographs of the items and the note, which have been referenced in legal filings.

Hotel security reportedly told Joseph there were no obvious signs of forced entry, and that only individuals with access from the tour’s management team could have entered the room. The lawsuit emphasizes this point, suggesting that the sequence of events raises serious questions about who could have placed the items inside.

Alleged Response by Management and Termination

Joseph’s lawsuit alleges that rather than launching a serious investigation or offering support, Smith’s management team accused him of lying about the incident, suggested he fabricated the story, and later “shamed” him for reporting it. Within days of the incident being reported, Joseph says he was informed that the tour was “moving in a different direction” and his involvement was no longer needed. Another violinist was promptly hired to replace him, according to the complaint.

Joseph’s attorneys argue that his termination constituted retaliation for reporting sexual harassment and that the reason given for his dismissal was a pretext designed to conceal illegal conduct. The lawsuit includes claims for wrongful termination under California employment law, retaliation for engaging in protected activity (reporting harassment), and intentional infliction of emotional distress.

Joseph is seeking unspecified monetary damages, asking a jury to compensate him for lost earnings, reputational harm, emotional suffering, and psychological trauma — including symptoms he says are consistent with post-traumatic stress disorder (PTSD) resulting from the incident and his firing.

Will Smith’s Response

In response to the lawsuit, Smith’s legal team issued a forceful denial of all allegations. In a statement provided to media outlets, Smith’s attorney, Allen B. Grodsky, characterized the claims as “false, baseless and reckless.” Grodsky said that Smith and his team intend to use “all legal means available” to address the claims and “ensure that the truth is brought to light.”

Neither Smith nor his representatives have publicly commented at length about the lawsuit beyond the statement from his attorney. There has been no criminal investigation announced, and no arrests or charges have been issued in connection with the hotel incident described in the lawsuit.

Legal analysts caution that civil lawsuits often include broad claims that will be tested through discovery, depositions, and potential motions to dismiss. At this stage, the allegations remain allegations — not proven facts — and Smith retains legal rights to challenge every element of the complaint.

Legal Context

Lawsuits alleging workplace sexual harassment and retaliation under California law can encompass a range of claims. Sexual harassment claims typically allege hostile work environment, unwelcome conduct, or quid pro quo harassment. Retaliation claims argue that an employer took adverse action — such as firing an employee — for engaging in legally protected activities like reporting harassment. Wrongful termination claims assert that an employee was fired in violation of public policy or contractual rights.

This legal matter also follows other controversies involving the Smith family. In late 2025, Smith’s wife, actress Jada Pinkett Smith, was reportedly sued for $3 million by a former associate alleging threats and intimidation — a separate legal dispute that has drawn headlines. While that case is distinct, the timing of multiple high-profile legal challenges has intensified scrutiny on the couple’s public image.

For Joseph, the lawsuit is more than a headline — it represents a bid for accountability and compensation for what he describes as career-ending consequences. Civil rights advocates and workplace safety organizations have noted that lawsuits like this highlight the importance of clear harassment reporting mechanisms and protections for touring artists and crew members who may face precarious employment conditions while on the road.

While civil lawsuits do not imply guilt, they do place public figures under scrutiny and can have long-lasting effects on reputation and professional opportunities. How this case will be resolved remains uncertain, but it is likely to be closely watched by legal observers, entertainment industry professionals and the public alike.
